Regulatory scope

What “investment advisory” means here — and what it does not

Stake rådgivning og invest ApS is not authorised by the Danish Financial Supervisory Authority (Finanstilsynet) and does not carry out any activity that requires such an authorisation.

What it is

  • Advice to a company’s board and management on the company’s own investment decisions in its business: capital expenditure, new markets, build-buy-partner choices, and which business units to grow, fix or exit.
  • Advice to companies on capital structure, industrial strategy and mergers or acquisitions of businesses — the corporate-finance advice MiFID II lists as an ancillary service (Directive 2014/65/EU, Annex I, Section B, point 3), which does not by itself require an investment-firm authorisation.
  • Preparing a company to talk to investors: the business plan, the equity story and the data room — written for and owned by the company.

What it is not

  • No advice to anyone on buying, selling or holding shares, bonds, funds, derivatives, crypto-assets or any other financial instrument.
  • No portfolio management, no discretionary mandates, and no receipt or holding of client money or securities.
  • No placing, selling or marketing of shares or other securities, and no introducing investors to companies for a fee.
  • No services to private individuals or retail investors, no loans or credit, and no projected or guaranteed returns.

When a company is deciding where to put its own capital — a new plant, a market entry, a system replacement, or which business unit deserves the next round of funding — we build the decision basis: the business case, the alternatives, the assumptions that matter most and what would have to be true for each option to work. “Portfolio” here means the company’s portfolio of businesses and projects, never a portfolio of securities.

We advise the company; we do not place, sell or market its shares, and we do not introduce investors for a fee.

Privacy notice — how we use what you send

  • Controller. Stake rådgivning og invest ApS, Kong Georgs Vej 38, 2000 Frederiksberg, Denmark, CVR 43059955. Contact: marketing@stakeradgivning.com.
  • What and why. Company name, your name, business email, practice area, company scale (annual-revenue band) and your description — only to assess and answer your request for an Executive Audit or consultation. Each of these is required for that.
  • Lawful basis. Steps taken at your request before entering into a contract, GDPR Article 6(1)(b). The optional business phone number, if you give one, is used only to arrange the conversation by phone and rests on our legitimate interest in doing so, Article 6(1)(f); you may object at any time under Article 21 and we will delete it. We do not ask for consent, because consent is not the basis for answering you.
  • Retention. Deleted 12 months after we receive it unless it becomes a contract. A scheduled job on the server performs the deletion.
  • Who sees it and where. Stake rådgivning og invest ApS, and Namecheap, Inc. as the hosting processor. The server is in the United States, outside the European Economic Area; the transfer rests on Standard Contractual Clauses, Article 46(2)(c) GDPR. Not sold, not used for advertising, no automated decision-making.
  • Your rights. Access, rectification, erasure, restriction, portability and objection (Articles 15–21 GDPR). You may complain to the Danish Data Protection Agency (Datatilsynet).
  • Anti-abuse. A salted one-way hash of your IP address is kept for minutes for rate limiting; the address itself is never stored.
